User Contract for YouTube Channel Collaboration

This User Contract (the “Contract”) is made and entered into as of [Date] (the “Effective Date”) by and between [YouTube Channel Name] (the “YouTube Channel”), and [User Name] (the “User”).

WHEREAS, the YouTube Channel has achieved monetization status and aims to create an extensive library of video game replays, specifically “longplays”; and

WHEREAS, the YouTube Channel desires to collaborate with the User to share their playthroughs and provide them with an opportunity to earn profits from their videos; and

WHEREAS, the User acknowledges and agrees to the terms and conditions set forth in this Contract.

NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the YouTube Channel and the User agree as follows:

1. Profit Sharing Details:

(a) For the first 20 videos that the User uploads to the YouTube Channel, the User shall receive 50% of the profits generated from those videos. The remaining 50% shall be held in an account on YouTube (“Account”) for the purpose of managing the channel and server expenses. Withdrawals from the Account shall only be made after consultation and agreement with the User.

(b) Once the User has uploaded more than 20 videos and has demonstrated their commitment to the collaboration, the User shall be entitled to receive 100% of the profits generated from every video uploaded thereafter. This entitlement shall continue for the lifetime of each video.

2. Transparency and Analytics:

(a) To maintain transparency, the YouTube Channel shall provide the User with access to their own analytics account on YouTube. The analytics account will enable the User to track the earnings generated by their videos in real-time.

3. Content Quality and Originality:

(a) The YouTube Channel emphasizes the importance of quality and originality in the videos submitted by the User. Therefore, each video submitted by the User shall undergo a duplicate content check to ensure that the content is fresh and has not been shared elsewhere.

4. Intellectual Property:

(a) The User represents and warrants that they have all necessary rights, licenses, and permissions to use and share the videos submitted to the YouTube Channel. The User retains ownership of the intellectual property rights in their videos, subject to the grant of rights specified in this Contract.

(b) The User grants the YouTube Channel a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, publicly display, and publicly perform the videos submitted by the User on the YouTube Channel and any associated platforms or media channels.

5. Miscellaneous:

(a) This Contract constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior negotiations, understandings, and agreements, whether oral or written.

(b) This Contract shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any disputes arising under or in connection with this Contract shall be subject to the exclusive jurisdiction of the courts of [Jurisdiction].
